GENERAL
All quotations made and orders received are subject
to these Conditions of Sale without alteration
unless confirmed by the seller in writing.
PRICES
a) Errors and omissions subject to correction.
b) Unless otherwise stated, prices charged will be
those ruling at the
time of dispatch.
c) Unless otherwise stated, prices include for the
supply and delivery
only of goods but not for off-loading, positioning
or installation.
d) All prices are exclusive of VAT which will be
charged at the rate
ruling at the date of dispatch.
PAYMENT
a) Cheque payments will be cleared through Equifax.
b) No charge is made to the customer for credit card
payments.
American Express is not accepted.
DELIVERY
a) Delivery dates are estimates only and the time of
delivery shall not
be of the essence of the contract. We shall not in
any event be liable
to compensate the Buyer for any damages or otherwise
for non
delivery or late delivery of goods or for any loss
consequential or
Otherwise arising therefrom.
b) Our adherence to promise delivery dates subject
to not being
delayed by lack of instructions, site, dimensions
etc.
c) The Buyer shall provide adequate unloading
facilities at the
place of delivery.
d) If adequate notice of approximate arrival time is
required this
must be stated on the order.
e) Any assistance given by the Carrier beyond the
usual place of
collection or delivery is at the sole risk of the
Buyer.
f) Unless expressly agreed in writing, our prices
only cover delivery
on normal working days and during normal working
hours.
ILLUSTRATIONS
Illustrations in catalogues or literature must be
accepted as showing
type, class and general character only without
warranty or
guarantee as to colour, substance, size, thickness
and shape.
SUITABILITY OF EQUIPMENT (SEE ALSO REPRESENTATIONS)
Goods are not sold on a trial basis. Customers
should check
specifications and suitability before ordering.

does not warrant the suitability of goods for
specific applications.
SPECIALS
Where the goods supplied are to the Buyer's design
the Seller will
not be responsible for the operation or performance
of the goods.
RETURN OF GOODS OR CANCELLATION
a) Standard items. A cancellation charge of 25% of
net invoice
value will be made.
b) Specials. Items manufactured to special order
will not be
cancellable and must be paid for in advance of work
commencing.
c) No return can be accepted without prior written
approval.
d) There is a 25% restocking charge on all returned
goods with a
minimum charge of £75 also freight must be paid on
the return.
e) Additional charges will be applied if there has
been any
damage to goods which has to be rectified.
SERVICE CHARGES
a) Out of warranty repairs and rework is charged at
the same
amount as charged to us.
DAMAGE OR LOSS IN TRANSIT
a) Goods should be examined on arrival and any
damage or
shortage entered on the carrier's note. Goods must
be signed
for "unexamined" and any damage must be reported to
us within 2 days of delivery. If not signed 'unexamined' then
carriers
accept no responsibility.
CARRIAGE
a) Overnight delivery prices require a quote.
b) Carriage is free to UK Mainland. For Scotland,
North of Perth / NI /
Channel Isles and offshore islands will be quoted if
applicable.
TITLE RESERVATION
a) Title to the goods will not pass to the Buyer
until payment
has been received in full.
b) If the Buyer shall default in payment of any sum due to us, we
shall be entitled forthwith to repossess any goods
and the
Buyer shall, for that purpose, afford us access to
and we shall
be entitled to enter any premises in the occupation
of the buyer
or to which he has access and where the goods may be
situated.
DEFECTIVE GOODS/MANUFACTURERS WARRANTY
Where the goods supplied are to the Seller's design
and
manufacture, defects will be made good subject to
the following
conditions:-
a) The Buyer shall notify the Seller in writing as
soon as
practicable after the defect becomes known.
b) The Seller has the opportunity to examine the
goods
c) There has been no neglect or misuse or incorrect
installation
of the goods.
d) Liability is limited to the free repair or
exchange of goods within
a period of 12 months from dispatch from the
Seller's premises.
e) Where goods or components are not of the Seller's
design and
manufacture, the Seller's liability shall be limited
to the guarantee
of the Supplier.
f) The Manufacturer/Importer offers a full 12 months
parts and labour warranty against defective parts or
manufacturing error.
REPRESENTATIONS
a) The customer is responsible for the suitability
of the items
ordered.
b) Goods are supplied on the basis that they conform
to current
sales literature (see also Illustrations) and may be
amended
at any time without prior notification. No other
representation
whether verbal or written shall have any force or
effect.
INSTALLATION
a) With the exception of Glasswashers, Dishwashers
and
Combi-Steamers all equipment supplied by Target
Direct Ltd is
supplied on the basis of supply only and
installation is not
in included.
b) It is the customers responsibility to ensure that
equipment is
installed by correctly qualified persons to
professional standards.
All Gas equipment MUST be installed by a
suitably qualified engineer.
It is illegal for gas equipment to be fitted in any
other way.
Target Direct Ltd accepts no responsibility for any
problems related to poor installation or lack of
correct services to supply equipment. |
